• 1. Scope and Booking These General Terms and Conditions of Rental apply to the letting of the Capazza Vista holiday flat for private tourist purposes. The tenancy agreement comes into effect upon the binding booking and the corresponding booking confirmation. In particular, the booked travel period, the agreed total price, the number of guests and any additional services agreed upon shall be decisive. Individual agreements between the landlord and the guest take precedence.

• 2. Occupancy The holiday flat is generally intended for a maximum of 4 people. Children are included in the number of people. An additional sleeping arrangement on the sofa for a child or teenager may only be arranged by prior agreement. Unregistered additional overnight guests are not permitted without the landlord’s prior consent.

• 3. Minimum stay The minimum stay at Capazza Vista is 4 nights. Different minimum stays may apply for certain travel periods or on the basis of individual agreements. The minimum stay specified at the time of booking shall prevail.

• 4. Rental price and services The agreed total price and the services included therein are set out in the booking confirmation. Additional costs will only be charged if they are stated at the time of booking, have been expressly agreed, or are required by law. The flat-rate charge for dogs is €30.00 per stay.

• 5. Payment Payment shall be made in accordance with the payment terms and deadlines specified in the booking confirmation. If payments due are not made despite a corresponding request and the setting of a reasonable deadline, the statutory provisions shall apply.

• 6. Cancellation by the guest The guest may cancel the booking before the start of the stay. The date on which the cancellation is received by the landlord shall be decisive. The following cancellation conditions apply:

Up to 30 days before arrival: free cancellation.

29 to 15 days before arrival: 50 per cent of the agreed total price.

From 14 days before arrival and in the event of a no-show: 100 per cent of the agreed total price.

• 7. Arrival and check-in Check-in is possible from 3.00 pm on the day of arrival. The guest will receive information regarding access and key collection in good time before arrival. Early arrival is only possible by prior arrangement and subject to availability. Any obvious defects or complaints should be reported as soon as possible so that we have the opportunity to rectify the situation.

• 8. Departure and Check-out On the day of departure, the holiday flat is available until 10.00. The accommodation must be left in a tidy condition. Personal belongings must be taken with you; crockery and kitchen utensils must be left clean; and rubbish must be disposed of in accordance with local regulations. Standard end-of-stay cleaning is included in the agreed rental service, unless otherwise stated in the booking confirmation. In the event of exceptional soiling or cleaning or waste disposal costs that significantly exceed the usual level, reasonable additional costs actually incurred may be charged in accordance with statutory provisions.

• 9. Early Departure In the event of a voluntary early departure, there is generally no entitlement to a pro-rata refund of the rental price, unless otherwise agreed or a statutory right to a refund exists. 

• 10. Dogs are very welcome at Capazza Vista. Please let us know when booking that you will be bringing your dog. The flat-rate charge for dogs is €30.00 per stay. Guests must ensure that their dog does not cause any unreasonable disturbance to neighbours or other residents. • 11. Duty of care and damage The holiday flat, the garden, the furnishings and the items provided must be treated with care and used for their intended purpose. Any damage or defects that arise or are discovered must be reported to the landlord as soon as possible. The statutory provisions apply to damage caused through the fault of the guest, their travelling companions or visitors. The guest shall not be liable for normal wear and tear resulting from use in accordance with the terms of the contract.

• 12. Security Deposit No security deposit is required for Capazza Vista. This does not affect any potential legal liability for damage caused through negligence.

• 13. House Rules and Consideration for Others The house rules published for Capazza Vista form an integral part of the terms and conditions governing the stay. Guests must show consideration for neighbours and other residents of the holiday complex. Parties, events and large gatherings are not permitted. Smoking is not permitted inside the holiday flat.

• 14. Wi-Fi / Internet Wi-Fi is available to guests free of charge during their stay. An uninterrupted connection at all times or a specific connection speed cannot be guaranteed, particularly where disruptions are beyond the landlord’s control. Internet access may only be used in accordance with the applicable legal provisions.

• 15. Exceptional circumstances If the holiday let cannot be made available in accordance with the contract due to exceptional, unavoidable circumstances for which the landlord is not responsible, the statutory provisions shall apply. These may include, for example, significant damage to the accommodation, official orders, natural disasters or unforeseeable, significant disruptions to the local infrastructure.

• 16.Liability The statutory provisions apply to the liability of the landlord and the guest. The guest is solely responsible for their own arrival and departure. Mandatory statutory liability provisions remain unaffected.

• 17. Registration and Identification Obligations Guests shall provide the information and documents required for the identification and registration prescribed by law in good time. This may include, in particular, the presentation of the necessary identity documents for all persons travelling with the guest. The data will be processed exclusively in accordance with statutory requirements and the privacy policy.

• 18. Data Protection Personal data shall be processed exclusively in accordance with the applicable data protection regulations and for the purpose of processing the booking and fulfilling legal obligations. Further details are set out in the separate privacy policy on this website.

• 19. Safety Regulations Capazza Vista is operated in accordance with the legal requirements applicable to holiday lettings. Existing safety devices must not be removed, damaged, tampered with or rendered inoperable.

• 21. Governing Law The tenancy agreement is governed by Italian law. Mandatory consumer protection provisions applicable by virtue of the guest’s habitual residence or other statutory provisions remain unaffected.

• 22. Jurisdiction In the event of disputes arising from or in connection with the tenancy agreement, the statutory provisions on jurisdiction and international competence shall apply. Mandatory consumer protection provisions remain unaffected.

• 23. Final provisions Individual agreements between the landlord and the guest shall take precedence over these General Terms and Conditions of Tenancy. Should any individual provisions of these Rental Terms and Conditions be or become wholly or partially invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions. The version of these Rental Terms and Conditions in force at the time the relevant contract is concluded shall apply.
